I live in staten island, new york and I just recently rented one of my apartments. I listed it with a real estate and told the real estate that I did not want to rent to someone with children that I would prefer an older couple. The real estate brought a very nice older couple and we rented the apt to them. A few weeks later, starting at 8 am until 7 pm all I heard was children running back and forth through the rooms all day long. When I mentioned to the tenants that maybe they should remove the children's shoes they told me "you knew I babysit 3 days a week". I told them I did not know this and they said they told the real estate all about it. The real estate never told me about this. When I rented the apt to them, I removed all the rugs in the rooms and had a professional come in and sand down the floors and polyuruthane them. If I had known about the children, I would have laid down rugs instead to keep the noise down. My question is do I have any case against the real estate firm who lied to me. I have nothing against the tenants. thanks for your help

If I were you I would just drop it. Reason being, you are guilty of discrimination and violation of the Federal Fair Housing Act. You can not discriminate yourself and also ask the real estate agent to NOT rent to families with children.
