Good Day, I live in Newburgh, NY. and in 1993 we purchased a newly build bi-level home. On my property sits a steel box that's approx: 7' from the road, a transformer.
Prior to purchasing this property our contractor informed us that the box can be removed upon ownership with just one phone call. Although NYS. Real Property Actions/Proceedings, Chap: 81, Article 8, Section 871 clearly paves the way for cause of action, local Town rules and regulations may cause problem.
My neighbors who were there before us informed me that the box was originally on my neighbors property. Workers then stated to them that the box will removed and placed on the property line. This never happened, it was placed on the vacant property that was later purchased by us.
Question:

1. Is there a cause for action here or any similar cases that was successful in the Courts?
