State is Alabama, Purchasing a VA foreclosure through a real estate agent. Have not heard from agent since I won bid. I have called agent 2 times asking about closing schedule and what info agent needed from me to send to VA. Day of the last call, I received a letter from VA stating we would be closing in 1 week! Called agent, said she would get right back to me, that was 3 days ago.
Of course if I do not close on the VA's date I will forfeit my deposit.
I look at it as the agent had a responsibility to me and to the VA to gather the info in a timely manner, to assure a close.
Do I have a legal leg to stand on to 1) at least get my deposit back, 2) sue for the agent for the difference in what I would have paid for the house versus the appraised value of the house, which is about $23.000.00 I will be loosing in net worth.
