I spoke to my attorney this morning and she informed me that the plaintiff refused a check to repair their car. Instead, the plaintiff sent the check back along with a lengthy letter attempting to justify a higher amount to repair his vehicle. Plaintiff is also related to attorney.

My attorney is saying that the plaintiff wants the blue book value for his vehicle. My attorney states that the plaintif is only allowed a reasonable compensation to repair their vehicle under california law. Is this true?

Also, if in the law suit there was not any mention of bodily injury, can the plaintiff attempt to claim damages at some later date?

I would appreciate your advice, thank you.

Well if you give the plaintiff book value for the car..then YOUR insurance company gets to keep the car....its called totalled!
