What is the name of your state? Ca.
I was rear ended by a trucker when I merged onto the freeway, I have a witness that says he speed up after I merged into the lane. I could not accelerate as there was a car in front of me, he hit me in the rear and sent me spinning. No body got hurt but he totalled my truck, he is from out of state, what law would this be under and how do I go about filing charges? Note, there was a light rain falling and we were travelling about 50 miles an hour and according to the police report he did see me.
