My husband was rearended by an uninsured motorist, and we only have liability. The other driver was ticketed for careless driving. I gave him proof of our damages (estimates for repair and blue book value). The estimates came up to about $5,000, and the truck is valued at $6,000. The other driver never contacted us about making payments, and after repeated attempts on my part, I gave up and said see you in court.

My questions (finally) are: We can't afford to fix the truck, but we can't leave it parked on the street. If we get rid of it (junk yard), do we lose our right to be compensated for the damages? Is this a matter for small claims court, or do we need a lawyer? Is there any chance of recovering our loses or is this a lost cause?

P.S. Our insurance is going to pay for my husbands medical bills, because we had uninsured motorist coverage. It only covers bodily injury.
