rear-ended in texas

What is the name of your state? Texas . I just wanted to know why the at fault drivers insurance company has not offered any settlement. My wife was rear-ended and the other drivers insurance company paid for repairs but has not contacted us again regarding her medical bills, time off from work, etc. We have faxed copies of all bills and a letter stating her current medical condition, which is much better now. Do we need to keep contacting the insurance company or contact an attorney?

There could be a million different reasons they haven't offered you a settlement, starting with the fact that it sounds like you having been calling or writing and asking them about it. You need to send them a copy of everything certified mail, and include a letter asking when they're prepared to settle for the remainder of your damages. Or file this with your own insurance company and let them go after the other company for you;.

In TX, you should use your OWN insurance policy for medical bills. You should have PIP or medical payments coverage.

If you are looking for pain and suffering and lost wages and such, you'll have a much easier time of it if you hire an attorney.

The insurance company is not just going to call you up and make an offer, and then send you a check wrapped up in a pretty box with a big bow on top.

Insurance companies are there to make money, NOT GIVE IT AWAY!

You are going to have to call them and ask and/or hire an attorney (or at least threaten to) unless there is some sort of resolution soon.

We were severely rear-ended 18 months ago, and the at-fault's insurance company has yet to OFFER a penny!

We have an attorney and the demand letter was just sent. They (the insurance company) knows they are going to have to pay, but they figure, "Hey...LET THEM FIGHT FOR IT!

That's just the way it goes. :(

Actually, our insurance company is the same company as the at fault drivers insurance company, just different agents. We have not been calling them. We have simply mailed and faxed the information from lost wages and medical bills to them.

Thanks for the reply. I definately do not expect fed-ex to ring my bell with a package full of cash. The at fault driver has the same insurance company as we do. We have been with them for 25 years and expect better from them. We did mention hiring an attorney to a rep from their home office and he didnt want to talk anymore.
