A few days ago, we were stopped behind a car which was waiting to make a turn when we were rear-ended by a car going at about 50-55 miles an hour. Our car is totalled. It was only a fews weeks old! I have severe whiplash (back, neck) and pain all over!! I was taken to the hospital by ambulance, had x-rays which showed nothing "broken" and was released. Saw my regular doctor who ordered an MRI and physical therapy. My question is this; since I am already on SS disability for a prior back injury, have had surgery and subsequent back problems (fractures, herniated disks, etc.), am I entitled to anything under NYS law for THIS accident ( NYS disability, etc.)? We do intend to sue for pain and suffering and any future medical expenses. I am terrified about my future and the subsequent damage whiplash can cause. Also, my husband sustained injuries as well but since he has been unemployed (through no fault of his own)and had been actively pursuing work for many years, is he eligible for any "lost earnings" under the law? We also need to find an attorney in NY who treats "whiplash" as the serious injury it is, especially someone with my prior back injuries! We have great insurance, eye witnesses to the accident and a police report...there is no question as far as liability goes. Thanks for your help.

I think that you are on the right track - get a lawyer who knows how to handle a whiplash case with a pre-existing injury.
