I had a partner in business that I am a benficiary to a life claim. The deceased passed on due to an accident within 2 years of issuance of the policy. The deceased was in an alcoholic rehab program in the 1980s. He answered all questions honestly and passed the physical with flying colors in 2003. The one exception on the application was have you ever been treated for alcoholism? He answered no to that question. In his defense he was treated long ago and many of the questions regarding health were only in relation to 10 years of past history. Does the insurance have on obligation to pay the full amount? They originally did their due diligence prior to issuing the policy.

How do you know that they did due diligence? If they pay out on this policy you will be very lucky because they have every right not to. His denial was an outright and deliberate lie because he knew his application would not be approved, and apparently you don't understand the meaning of the word "no" either, because YOU are expecting them to still make a payout. And if the policy did not cover accidental death they can deny to pay out for that reason as well.
