CA...I bought a new car in June and I received 1000.00 off the car for using their financing. There was a rebate of 2500.00 option that I chose not to do. In July I received a check for 2500.00. Now in Oct the dealership is calling and saying that they never should have sent the check and they want it back. Do I leagally have to give the money back?

Yes, if it wasn't a part of your deal and you have nothing in writing saying it belongs to you, then it doesn't.

If you opted for the low finance than you are not entitled to the rebate. You can make it difficult for them to collect, but is that the right thing to do ?

If it was a manufacturer's rebate which it sounds like it was (no dealer's I know, which are totally separate from the Manufacturer gives a rebate that large)... 'THEY' the dealer pocketed the rebate.

You should have taken the rebate and applied it to the vehicle purchase. Rates are fairly low everywhere. What did they offer 1%?

The manufacturer sent you the check because the dealer screwed up their paper work stating the check was going to 'you'.
