Received damaged item/owner says self inflicted

I am not sure this should go in this heading, but it was the closest IMO.

I am writing this for a friend and need advice.

"Jan" purchased a handbag via telephone in New Jersey. The handbag was on sale and deemed a final sale. Jan received the handbag that was sent and it was clearly damaged. Peeling and missing leather in various places. Jan called the boutique and was told they were going to call their supplier. Jan repeatedly phoned when the did not get back to her. Jan sent the boutique photos of the damage along with an email sating that this was unacceptable and she would like another bag. She couriered the bag back to the boutique. (She had spoken with her CC company and they said they could not start a chargeback until the bag was out of her posession and she had tried to return it) The owner of the boutique now is saying to Jan (after several dodging phone calls) that she must have damaged the bag herself. And that since the bag was a final sale, she was out of luck. However this damage was not disclosed to her at the time of purchase.

She never wanted her money back, but an undamaged handbag. Now they are accusing her of damaging the bag herself.

Any advice on steps she can take if the CC company does not help her with a chargeback? This is over a thousand dollar purchase, so it does need to be resolved.

ETA.. She just spoke to another owner who was screaming at her that he inspected the bag himself, so she must have used and damaged the bag.

This is ridiculous!

Forget taking a replacement bag. Just file for the chargeback.

How long did Jan have the bag in her possession before she called the seller? Was there any insurance on the shipment of the bag (surely, for a $1000 bag!!)? Since the bag has been returned Jan should do the chargeback. Does she really want to deal with these people any more?

Yes, actually people make purchases of somewhat large amounts often without seeing the item first.

Actually, what has transpired with the boutique has been quite the story.

Long story short, the boutique is being investigated for illegal activities. The cc has issued chargeback.
