Reclaiming an RV

My husband helped his father get an RV trailer in 2005. My husband secured the financing, his name is on the title, registration, and insurance. His father was supposed to get his finances in order and get his own loan and essentially buy the trailer from my husband. In the mean time, he was to make the payments, pay for the registration and insurance. He made payments sporadically, and never paid the registration or insurance. My husband has been making these payments, instead. The trailer is in another city, on land that my husband and I do not own.

Because of the financial burden of this trailer, my husband would like to reclaim it and either sell it or rent it out. Here is the sticking point, though. My father-in-law has been living in the trailer. It is equipped as a residence (i.e. bed, kitchen, bathroom...) Does this make it a landlord/tenant situation? Will my husband need to follow an eviction process before he can reclaim the trailer? If so, what will he need to do?

I've been trying, but laws are why there are lawyers, which I am definitely not. :rolleyes:
AZ statute 33-1304 specifies the scope of the landlord/tenant chapter as "This chapter shall apply to the rental of dwelling units."
Statute 33-1310 defines "'Dwelling unit' means a structure or the part of a structure that is used as a home, residence, or sleeping place by one person who maintains a household or by two or more persons who maintain a common household. 'Dwelling unit' excludes real property used to accommodate a mobile home, unless the mobile home is rented or leased by the landlord."

I guess my question would be is an RV trailer a "structure?"
