My husband helped his father get an RV trailer in 2005. My husband secured the financing, his name is on the title, registration, and insurance. His father was supposed to get his finances in order and get his own loan and essentially buy the trailer from my husband. In the mean time, he was to make the payments, pay for the registration and insurance. He made payments sporadically, and never paid the registration or insurance. My husband has been making these payments, instead. The trailer is in another city, on land that my husband and I do not own.
Because of the financial burden of this trailer, my husband would like to reclaim it and either sell it or rent it out. Here is the sticking point, though. My father-in-law has been living in the trailer. It is equipped as a residence (i.e. bed, kitchen, bathroom...) Does this make it a landlord/tenant situation? Will my husband need to follow an eviction process before he can reclaim the trailer? If so, what will he need to do?
