My stepson is living with his mom and stepdad in WI for the moment. We are in the midst of trying to mediate/litigate past her "objections" (read: she doesn't want to pay c/s) to get him back with us in MO. Obviously we need her legal say-so to move him out of state and are doing all the legal things necessary to make this so. However...

My stepson (14 years old) informed me tonight that his stepdad was bullying him about a conversation he (ss) had with me last week. Stepdad told stepson that he had the conversation on tape!

Other ramifications aside, my question is this: is this legal? Stepson called me, so it was definitely not a case of answering machine error; it was deliberate. And stepdad was not on the telephone at any time.

Thanks in advance.

You can check this site to see what the laws are Can we tape

My suggestion as far as c/s is concerned, forget about it for a while. Stipulate in the papers that no c/s is requested AT THIS TIME. Wait a while, then file for it. Oh, I know it's not fair but you want to get your kid right? I dunno, just a thought, I leave it with you. It just seems to me that step daddy is putting the child in the middle, best to get him out of that situation fast..and then you (and your house) won't have to deal with any longer either
