I live in Texas, and it's been a little over a year now since my house was broken into, and I'm trying to decide whether to file a small claims lawsuit (around $3000) against the guy who did it, to at least recover some of the money not only for the items taken that I didn't get back, but also the damage done to my house. He served some prison time, but I believe is out now. Or should I just forget it?

You can sue the guy 'till the cows come home', and might even get a judgment. But, unless the debtor is willing and able to pay the judgment (unlikely since he is already shown in ethics by being a criminal!), you will never be able to collect from him.
