i posted on another thread about my sons scd. he is 18. happened when he was 16. we are trying to get it cleared up to just say dismissed. Recruiter and his boss called us in today. Told us 1) if he says he was arrested, and the acd is cleared, no problem, 2) if he says he was arrested and it still shows "dismissed/acd, he will not be able to enlist or if they apply for waiver it will be very unlikely. They also said 1) say "no" on the form to being arrested 2) the army only checks finger prints and since he wasn't printed they will never know 3) if I or my son tell anyone about this that their careers are done, so even on the form where it asks "has anyone told you to lie" to say no (clearly if the army questionairre asks this there is a problem) 4) they said the MEPS guys will ask him the same questions and he has to say he wasn't arrested, and will show him a "drawer full of files and say "those are all the people that lied to me and i put them in jail..". went on to say that MEPS guy will asks him if recruiters told him to lie and he has to say no (another lie!)

what happens if son wants a higher clearance.someone somewhere will find the lie and he will get in trouble,..then where will those recruiters be? I am SHOCKED that the ARMY (this is 2 recruiters, one is the guy in charge) that are telling us this...they are influencing my son and he really wants to be in the army. I like these guys as people, and i think it is a shame that a stupid act at 16 will prevent him from joining, but to tell someone to LIE on a FEDERAL document that clearly states lying is a federal offense, ...I have a problem with that....so, what does he do...lie to get in, be honest and not get in, and if he does lie, what are the potential consequences..oh, and if it shows as completely dismissed, it doesn't discount the fact that he was in fact arrested, correct? so he still has to say yes" sorry for long post

If he lies and it's later discovered, there's a good chance he will be chaptered out as a fraudulent enlistment which will kill any chance of him ever enlisting.

This is your son's best bet: find a different recruiter. Tell him or her everything, and tell him that he's not willing to lie. There's a chance that he won't be able to enlist. At least right now. But enlistment standards change, and offenses that aren't waiverable right now may be a year from now. But if he lies and gets caught, he won't EVER be able to enlist. Because he'll be booted out with a dishonorable discharge.

See this thread for more info on the possible penalties: https://forum.freeadvice.com/military-law-92/fraudulent-enlistment-penalties-515469.html or google "fraudulent enlistment" for additional information.

You can send me a private message if you wish to find out how to report these recruiters who are pressuring your son to lie. Of course, to do this your son would have to be willing to make a formal statement.
