What is the name of your state? California

I am asking this question as i am currious on what's the law.

If i own a home and it get red tag by the city due to possible mudslides. Can i refuse to leave the house or would they legallly have a right to remove me. The reason why i ask this question is because during last year fires people were able to refuse to leave the house even do mandatory evacuation were ordered.

homeguru kind of confused by your answer, during fire season during mandatory evacuation city said they could not remove people by force, so then how are they able to remove people by force when house is red tag?

is fire and reg tag covered by different law?

**A: yes, contact your AHJ ( local Building Department)

**A: they should follow the IBC ( International Building Code) formerly the UBC. Once a property is red-tagged, the prosecutor can serve occupants notice to vacate through civil action and the police can arrest those not in compliance.

Homeless "Tenant" Won't Leave Red Tagged House

Also California: We are in jeopardy of being fined because a homeless man moved into the back house on our rental property, which is red tagged. We intended to fix it someday when we can afford it and have been using it strictly for storage. We rent out the front house. The property is a 4 hour drive from our personal home. The guy refuses to leave stating we can pay him to(Which we can't afford to do) or evict him. I haven't found any information on how to evict someone from a red tagged house. He is now threatening that he could sue us(!) for having an unlivable house! How do we get rid of this guy?

I suggest you have him arrested for trespassing.
