I purchased a digital transcriberand software program from a transcription company(If you wanted to work for them, you had to purchase their equipment(Which came on a CD). However, in the contract I signed and on their web page they say nothing about The equipment being NONREFUNDABLE. Anyway, I had it for almost a week and then circumstance came up and I returned it. He told me that it has always been their policy of no refunds, but like I said he never told me that, its not in the contract nor in any of the newsletters, web page, etc. I guess what I want to know is is there anything that I can do?

My response:

Bad news.

There are no laws, in any State, requiring a merchant to accept most forms of returned goods* in exchange for a refund. Merchants do, in fact, issue refunds as a matter of store or company policy, and for reasons of "good will" in the community - - that's a "policy" and not a law. If a product is not defective, and it will perform as designed, then a merchant does not have to issue refunds.

IAAL

* merchants who sell products sold door-to-door, and not purchased at the merchant's place of business, are usually required by law to give a 3-day return period in exchange for a full refund.
