Refusing delivery on ordered item I don't want.

What is the name of your state? California

If you purchase something from a website that has a no return policy, but when the item is shipped you refuse delivery (and it is sent back to the merchant), doesn't the merchant have to credit you the full purchase price? Does it vary state by state?

I cannot imagine the merchant can keep the money and the shipped merchandise.

Note: in this case the store is located in Illinois. Also note: the website says the store does not accept returns (for those who might say: it depends on the terms and agreements outlined on the website).

Nope. The seller may have incurred additonal shipping fees due to you rejecting the item, you can be held liable for those fees too.

Sure they can. They will hold YOUR merchandise for a specific period till you accept it. You will likely receive a letter notifying you of the options that can happen to YOUR purchase. If you don't accept it, they put it back on the shelf or donate it to charity.

This point is moot. Accepting the returned item does not mean the seller is voiding their return policy on this item.

My response:

EDS, you're obviously thinking under the misbelief that you can buy something and the merchant is legally obligated to refund a customer's money. This is not so, amigo. Once you buy something, it's yours - - unless the item doesn't do as advertised or as intended. Other than that, you're simply out of luck - - and the money belongs to the merchant.

I wasn't to sure what the legal ramifications were. Thanks for the advice. I'll keep it in mind on my next online purchases.

Why didn't you cancel the order?

Since they notified you in advance that they do not accept returns, they are not obligated to accept it. What was the item?

If you charged your purchase by credit card, you should be complaining to them.
