Regaining custody of my son from my mother.

Temple, Texas is where my son resides and where the petition was originally filed. I am in the military. I currently live in Izmir, Turkey. I gave my mother primary conservatorship and myself secondary in order to join the Air Force. We were supposed to have it signed back over to me but just never have. It has been this way for four years. My son has lived with me since January 1998. He moved to Turkey with me and stayed here for six months. My mom came to visit and he asked if he could go and stay with her for two months. I agreed since most of my family is there. Now she won't let him come back. What do I do? I want my son back. I have supported him financially since Jan 1998. Can I file a petition without actually being in Texas. How do I do this? Please help.

Who has legal custody of the child? If you have a texas court order giving you physical custody, then just ask the state police to go with you to her house. If you can not go to Texas (you going to have to when you need to pick him up) then file kidnapping charges against her.

a conservatorship does not over rule your rights as a parent. It just allows her to manage things when you are not around.

Personally, a well worded letter might do the trick if she realises that the police are going to come knocking soon. Also, tell her that if she does not return your child, after the legal stuff is out of the way, you will never again allow her to have access.

Failing all of the above.. retain an attorney in Texas and have the conservatorship cancelled and a judge to order her to release the child.
