What is the name of your state (only U.S. law)? VA
In late April of this year my husband listed our two ferrets on craigslist to be re-homed for $75.00 along with their cage and all items we have for them. Well that day two ladies came to our home to pick them up. Let's call them Jane and Mary. Jane had came in and said that she was the one who was going to be taking them and she just had her friend Mary tag along for the ride. We agreed that Jane could have the ferrets under some agreements. 1- They are to stay with her and not be re-homed again 2- If for any reason she could not keep them we were to receive a call and my husband and myself will take them back, no questions asked. 3- They are to NEVER go to a shelter. All of this was agreed upon. (We did not have anything in writing, just verbal agreement.) My husband was asked to drive the ferret cage to Jane's house and she would pay him an additional $25.00 for gas, for a total of $100.00 for the ferrets, all their items and delivery. When we arrived to the apartment complex that Jane said she lived at she took us to her apartment and told us that this was her home. At that time we had no reason to question her. Than the during the week of May 17 we had received a call from Mary acting like she was Jane, saying that she could no longer care for the ferrets that she feel into hard times and she was expecting to have a baby soon. She said that she had a friend who would be willing to take them from her and she wanted to make sure that this was ok with us. My husband told her that would be fine, but he wanted to speak with the friends first to see what they were about. We never heard back from her about that. Than on June 2nd I had received a call from Mary saying that her friends would not be able to take the ferrets and she needs them gone now. My husband told her that we would be able to come out on Saturday to get them, Mary said that was fine. Than 2 hours later she had called me back telling me that I need to come now and get them or she will be "dumping" them tonight. All I told her was that she was not taking them to a shelter and I gave the phone to my husband. He spoke with her and her husband and when speaking with Mary she said that Jane was not able to afford the ferrets anymore and gave them to Mary to take care of and keep. And now Mary is expecting a baby and her husband can't stand them and wants them gone. My husband asked Mary is she was wanting any money for them and she said no that she just wants them out of her home. So we had rushed out and picked up the ferrets before any harm could come their way. We had gone to Mary's apartment and we saw that Mary's apartment was the same place that Jane told us was her home. When we had gotten them I had noticed that they have lost a lot of weight and they were rather skinny, and not to mention unsociable. (I have had them for 4 and 3 years and they were always at a healthy weight and very friendly) I didn't want to cause any problems there, my main worry was to get them home and take care of my babies, but when we got them home besides being thin, and unfriendly and smelling of weed as soon as they took 2 steps out of the carrier they both fell to the ground. They were too weak to walk around. We had asked Mary for their birth certificates back and all of the papers I had given Jane when they first picked the ferrets up in April. She said that she would have to get with Jane and mail them to us. So my husband worried that we would never get our papers back had called Jane and asked her to mail them. She said that she would put them in the mail the next day. Than Jane had called back a few hours later saying that she was going to report us to the cops for stealing the ferrets from her and stealing her money. That we owed her money for taking the ferrets back and that Mary didn't own them. That they were staying at Mary's house while she was moving. And that she is going to take us to court over this and that we either have to A. Give her the ferrets back or B. Give her $100.00
I really want to know what I can do, because I will not give her the ferrets back, after seeing how they were cared for and then to be lied to about everything. I do not feel that she deserves to get the $100.00 back as first $25 was towards our gas for dropping them off. And second Mary was the one who had the ferrets in her home and told us that Jane had given them to her, we had asked Mary if she wanted any money and she kept telling us no to get them out of her home or she would do it herself.
If you could please let me know what I can do about this. And please no nasty messages about why I gave them up to start. It was not something that I wanted to do, I had family staying with us at the time and they were having breathing problems because of the ferrets.
