I am getting ready to go to court to adjust the child support at my ex's request. My ex is a dead beat big time. Owes me over 80 grand now. My new spouse has provided my two childrens medical/dental coverage for at least 3 years now. How would I go about requesting thru court that my ex must reimburse my current spouse? Is this possible?

It was ordered that we both must furnish insurance for the children but in 14 years he has never had insurance for them. I have paid for every single medical bill there has been. How far back should I ask for him to reimburse me? I am gathering all the amounts I can for when we go back to court.

No he will NOT have reimburse your current spouse. If he is not following the court order you take him back to court for contempt. Of course do YOU have insurnace on your children and have you had insurance for the past 14 years? And I dont' mean medicaid. I mean insurance?

How long does your court order state that you have to give him the bills? Even if a time is not listed, did he have knowledge of all the appointments? Did he consent to the appointments? You will NOT be able to go back 14 years. The defense of laches easily kicks in.

I have had health coverage on our kids thru my employer from the beginning of our divorce. He has never ever had insurance for them. My new spouse has been providing it for the past 2 years now. We can't afford to have it thru my employer as well as my current spouse. There is no time frame listed in the court order. Just says he must supply health insurance coverage and pay 50% of any medical bills that exceed $45 per month.
He did not have knowledge of "all" of the appointments as he was not around for several years. These past 5 years he has been a bit more of a visitor in the kids lives. Although I did notify him of the dental appointments these past 2 years. He has no say in any medical/school/ religious decisions. If that matters.
He has been a dead beat for 14 years so these past 10 years I have not wasted the money and effort of filing contempt charges. I have let Support Enforcement do that when they feel like it. I got no results doing it thru my lawyer or the Support Enforcement. But now he is the one changing the child support order. I feel it's fair game to bring up the medical bills that I have paid over the years. Not sure what a judge would care to see.

DId you prove that you paid over $45 per month on medical bills? Did you send him that evidence? Did you send him copies of all the bills? Because if you did not and you did not send them in a reasonable amount of time after you got them then the defense of laches as well as waiver kicks in. A judge will not want to go back that far.

My bad. I should have sent him the copies of the bills. He would have said he never got them anyways. No biggy. He owes me so much anyway. It's not like I'll ever see it!
Thanks for you response! Now I know to be on top of it for the next bills!
