What is the name of your state (only U.S. law)? CA
I have primary custody of our two minor children. One of our children has struggled in school, largely due to lack of effort on his part. Multiple meetings with every school official by me over several years confirms this.
My ex felt I was not doing enough, and chose to enroll child into private tutoring franchise program. Almost 200 hours of prescribed tutoring resulted at $40/hr. No discussion with me, very poor communication between us.
Ex owes me $4k in back medical bills. At some point I need to file to enforce clear orders stating that she pays one-half. (Statute says she must pay, even if she files for relief)
At that point she will undoubtedly bring up my lack of contribution to tutoring, (even though child is tutored at school) and suggest that I am bad parent for not doing enough towards schooling. (Very manipulative, but school officials will say otherwise if asked) She has never provided copies of any bills, progress, etc. I have met with private tutor several times to discuss progress, results, etc.
Question: Regardless of what I may choose to do in terms of payment of private tutoring, what is likely to be the court's position on reimbursement if she requests it? (Remember that I have never been directly provided a copy of, or asked to pay any bill) The court denied my requests to have her pay 1/2 of private school tuition in the past, when I had them enrolled at private school.
Please keep in mind that I have not decided against payment yet, if provided with bills and a request for same. I ask about the court's position for perspective.
