What is the name of your state?ca I have filed a lawsuite against a driver who hit me in the rear. The insurance company turned it over to a lawer. After meeting with the lawer we came to settlement agreement. I signed the agreement with the lawer. this was about 60 days ago. I have a paid in full from my medical insurance, which they ask me for. after several calls i have not gotten the settlrment check. I did keep the lawsuite release form until I got the check. we have a confrence on July 13, 2004. Is there any thing i can get them to do to pay me.

Answer: A: Keep the release form and chances are your less likely to be paid any time soon. B: Turn over the form if you feel this is the best you'll receive for the amount of damage incurred. C. Talk to a lawyer or a "lawer" in your neck of the woods. D: Attend the conference with the assistance of legal aide. Know your rights and the rights lost once a release form is signed.

Think you for your answer. I did sign the release form gave it to their lawyer at the time it was signed. she turned it over to the insurance co. this was 60 days ago. I still have not gotten the check. according to their lawyer the insurance company will not relaeae the check.

Okay, what reason did the insurance company's attorney give you as to why the carrier wont release the check?

When you go to court on July 13, inform the judge that you reached a full settlement and signed the release but that the carrier is not paying. Ask the judge to set a settlement conference and to order the insurance adjuster to personally appear and explain what the problem is.

thank you very much for your reply. At frist they wanted to insure that there were no outstanding liens (medical) I provided a paid in full from my medical carrier and a copy of a 0 balance from the hospital. I never recieved any request in writing to provide this information. The insurance company and their lawyer were given the complete medical bills and who paid what and when.
