i live in oklahoma. i have a six month old girl and the father has nothing to do with her. we are not married and never have been. i want to ask him to give up rights how do i do this? also if he does not can i still name a different guardian in my will?

I'm not familiar with OK, specifically, but I can tell you in general that courts are reluctant to take away a father's rights unless you have a husband who wants to adopt her.

Also, you cannot just name another guardian in your will. Wills are for property only. I remember another post on this board regarding this issue but I can't seem to find it. I know that IAAL (I AM ALWAYS LIABLE) gave some comments on the issue. If I can find the thread I am thinking of, I will post a link.

Sorry to disagree with TxStep but wills are not for property only. My will specifically states who will be guardians of my children and even specifies second and third person incase something strange happens. I travel a lot and need everything from children to property spelled out. There are also trusts set up for the guardians and the children.
