I live in chicago. I've been going to court for custody for five years.My son is 7 yrs old. My son's father has 3 kids of his own.I'm a single parent the final decision is going to be made b-4 school starts (the end of Aug). I want to move to florida should I tell the judge now or ahould i wait for the verdict?How would this effect my case? I know already the father will say no.I want full custody would the judge let me leave. I'm not denying visitation to him. I will even offer to pay for the transportation to and from. I am pregnant mu unborn child father lives in FL. He moved out there to be with his son that he has not seen for 3 yrs(he's now 5) His son's mother did not let him be a part of his sons life untill now. This was an opportunity to be with his son.He's doing well out there. He found a job and is waiting for the out come of the case for me to move out there.

*if* the father is active in the child's life and exercises regular visitation... then there is a decent chance the judge would immediately award custody to the father on seeing your petition to move 1500 miles.

Unless you believe that you have a rock solid case, I would forget about asking the judge to move prior to the decision... However, once the decision is made, the father is obviously going to oppose any move and may reopen the custody case.. With the details given, there would be no reason for a judge to grant your request to move.

Your situation is all of your own making and the judge will take into account the best interest of this child, non others.
