My ex-husband and I have one daughter, age 7 and we all reside in Missouri. I am now remarried with an infant resulting from my new marriage. My husband and his family are from New York and he would love to move back there and my daughter would love to be close to his family also. If my husband's job were to transfer him to New York and he would make a substantial amount of money and we were able to provide a much better life for my daughter, what are our chances of being able to take her with us? She despises visits with her real dad and has been fighting with him for the past 6 1/2 years about not wanting to go and she is also in counseling because she feels like nobody cares what she wants. She wants to be with me, my husband and her new little brother. Would the judge listen to her and her therapist? Would we have to go to court in the same county that the divorce took place even if we don't reside in that county anymore? My daughter has also accused my ex of abuse and he was abusive to me when we were married. My ex sees my daughter every other Sunday and doesn't force her to have overnight visits anymore, which has helped her somewhat. He is 33 years old and still living at home. He doesn't show interest in her well-being. Please help.
