I'm in RI, the order is in MA and the NCP is in CT. I am planning to move out of state in a few months. The order doesn't state anything about relocating and visitation states reasonable visitation with reasonable notice to me, the CP. I was wondering could the NCP legaly contest the move since he's out of state already? Also he's only seen his son 3 times in 8 months, would that make a diffence? .

No, not from the court I didn't but from the father yes, he helped me move! I didn't know that I had to go to court to do that at the time. I've been living in RI for about 2 years now. The father lived here at the time and we moved within walking distance from him. I moved here so my son would be closer to his father, then 8 months later he moved to CT. Is that something he could come back to me on? This is amazing to me that no matter where he lives he can still stop a move by me.

If you presented to a court that you moved to accommodate him, and then he up'd and left.. then it is highly unlikely a court would stop your move. After all, despite being down the street from his child, he moved away. It always bewilders me that people can do this.. Write him a certified letter (return receipt) informing him of the move at least 30 days prior to the move...

Thank you LegalBeagle for your help. One more question, I don't have an exact date yet for the move, it will be with in the next 6 months, do I have to have the date set for the move before I send him the letter? I would hate to get a job and a home all set up and then have him drag this out in court for months. So could I just say that I will be moving with in the six months?
