remainder interest? got court papers in mail.

my husband passed away 4 years ago at the age of 32. now his father is trying to be made administrator of his estate. *i got court papers* he owned no property or car or had life insurance. the court paper said something about remainder interest/life interest of 60000. his father and i dont really get along since we had an argument about where he should be buried. is this a way for him to take control and have him moved? is there something im missing here? his dad has the money to hire lawyers and stuff and i really dont. he knws this and i worry he may be up to something. any info would help. thanks.

You are hereby notified that *dads name*shall make application to be appointed as Administrator of the estate of *deceased hubby's name*, deceased. All interested parties are entitled to be present.

Decedent owned/had interest in the following real estate with marketed value as noted: Decedent had a remainder interest in property in **** County. The property is subjest to a life interest of *his dads name*.

was that property marital property of any sort?

was not marital property. im guessing he had listed him as a beneficiary in his house papers. i know he changed his will and took my husband out of it. so i dont understand the need for this.

If not, you really need to. For one, no one on an internet forum is going to be able to give accurate advice for a situation that apparently is important to you. And second, there is some reason why the estate hasn't been settled after 4 years for a decedant who didn't own any property.

Sounds like he inherited property and that dad has a life estate in said property. Once dad dies, the property goes to son's estate. However since son died first, the remainder interest goes to son's estate with dad having a life estate. Did son (your hubby) have a will? Real estate goes by deed. If there was no one with rights of survivorship, YOU as his spouse would be first in line to inherit the remainder interest. YOU NEED an attorney.l

He owned property. But apparently not property his wife was aware of. She needs counsel.
