we live in virginia and want to marry. he obtained his divorce in oklahoma where there is a six month waiting period post final decree to remarry. he changed his residencey in december and the final decree is dated march 14.

judging from the name of this thread I believe that the lady's question is if her boyfriend and her can get married before the 6 month waiting period is over

We generally do not look to assume our posters intent.. otherwise we would spend most of our time correcting our answers.

I truly like sarcasim. Thank you. Yes! I would like to know if we still have to wait for the six months following the final decree. You can wear your pink suit if you like.

Providing the marriage in OK is final, then he is free to marry in VA. However, if you return to OK, then he could be in trouble..

I'm no laywer. In the state of Ok your divorce is final that day. Your considered single but can not marry in that state for 6 months. Since he is in VA he can remarrying but the marriage is not legal in the state of OK. If he does return he will have to remarrying again but only after the 6 months has expired. this info is located here under the state resources Oklahoma search for Divorce. I don't have the exact statue but here is what it stated.

Even though Oklahoma law prohibits remarriage to its divorced residents for six months following divorce, the prohibition is in the nature of a legal impediment to marriage, probably existing for the purpose of allowing some time to consider marital reunion. In Oklahoma, when you are divorced, you are divorced - a single person.
If you establish residence out-of-state, you are entitled to remarry there in accordance with any legal requirements that state may have. But, under current Oklahoma law, while you may marry outside of Oklahoma, if you return to Oklahoma during the six month period and actually live together as husband and wife during that time, you would be committing a crime under Oklahoma law.
