I have been divorced for 6 years. I am in Indiana and have the custody of our two children. I am planning on getting remarried and would be moving to Va. I understand I need to file papers with the court here. Their father hasn't seen, called, talked to his children in over a year now. He isn't paying support as he is ordered. Sometimes I get something then sometimes nothing at all. He has left the country. He claims to be in the army or army reserves over there but no one seems to be able to verify that. I understand also that he can contest this move. My question, since he has not been a part of their lives or had contact with them other than the sometimes support, can he actually win a case that would prevent us from moving? The kids are very happy and excited about moving. Thanks

He can contest the move but the chances of him succeeding in preventing it is nil to none. Especially with his history of non payment of support and non contact with the children. Your reasons for getting the move ok'ed by the courts is to CYA, so he cannot come in at a later date and say you moved without his knowledge and consent.
