Hi,
I'm a resident of California, but this should be under US law.
My friend is into online games, and recently signed up for an online game called AdventureQuest. ( http://battleon.com ) He also signed up for the forums. ( http://forums2.battleon.com ) After a while, he got so into it that he decided to pay the $15 to upgrade his current game account to what is referred to as "Guardianship". The website says that it is a one time deal, and once you pay, you keep your guardianship forever. Basically that its a flat, one time deal. However, just this morning, this "Guardianship" status was taken away, due to "Repeatedly Breaking Forum Rules ". The website refuses to give a refund for the $15. My question is: Can they do this?
Why I'm in doubt whether they can is because when creating an account, AND when signing up for this "guardianship" there is no agreement, except for a privacy policy. There are rules, but you don't actually have to put a check and say "I agree to these rules". In fact, it doesn't even mention that there are rules when signing up for the game. When signing up for the forums there are rules, but only limited ones that you actually have to agree to abide by.
Again: Are they allowed to take the $15 when they claim that it is a flat, one time fee, for life?
