I live in Georgia and was wondering... My lease ends Jan 31, 2001. I gave a 30 day notice to move out on Dec 14, 2000. My actual clearing date is on 14 Feb, 2001. Am I responsible for any rent after Jan 31, 2001? Am I responsible for paying rent into February or longer if it takes longer to clear the house, even though I gave proper notice to move out by the end of the lease? I have actually been moved out since November, 2000 and have been paying rent till the lease is over. PLEASE HELP!!!!!!!!!!!

What do you do for a living? It must make you a LOT of money to be throwing it away like that....you lucky s.o.b!

If you not so rich and foolish with your money, you could have not even had to pay for decmber or januarys rent, if you had a new tenant move in and the landlord didnt lose any rent.

What is a clearing date? If you gave notice to be out by the end of January on dec 14th thats more then 30 days and you would be entitled to your security back, of course if you dont take pictures and do a walk thru with the owner...they will keep the deposit...why? because they are rednecks, and you will have to sue them for it in small claims court.

Now did you lease say you have to give a 60 day notice ? then you would owe rent at least until the 14th, and maybe the whole month, but then you have a security deposit right?

Maybe you should spend some time with this thingy called a computer and do some basic research on your living arrangements....eg: what rights do you and your landlord have in a lease, and what rights dont you have if you dont.

here is the problem with dec and jan rent, they refused to show the place or make a clearing date at the time we gave notice. They refuse to work with us. My husband is in the military and I work in the home , so no we are not rich by far. We have been trying to get rid of this place for a while. and being in a military town they know they will get thier money one way or another. But our biggest concern right now is not the past it is the here and now, all we want to know is if we are responsible for Feb. rent even though we gave notice and our lease is up on jan 31 and the landlords gave us a clearing date of Feb 14. No the lease did not require a 60 day notice we did that so there would be no confusion.AS for the deposit because my husband is military they took care of that. And we did search this thingy and came across this site and thought we could get some information that could help us. And why did we wait so long to get the info because I am to busy to sit here all day and search and my husband has been deployed alot. Again thank you for your help.

well you have a case to sue the landlord for not rerenting the place asap.....That is ILLEGAL in most states for the landlord to purposely keep the apartment empty and expect the tenant to keep paying rent till the end of the lease.

SO They have the keys right? you turned in your set and have a reciept right?Then you owe them zero....but you will have to do this in court....

You are miltary, you are irresponsible in most landlord's eyes in miltary towns... you are young, naive and probably have small kids.... AND HUBBYS GONE ON DUTY....OH BOY perfect for ripping off......

You in REDNECK territory girl...

Time to learn about your rights, and how to sue the landlord when you are ripped off, and you are.

just a thought sweetie...If your husband is military, you have a right to have a clause put in your lease saying that if you have to vacate the premises due to change of duty station or job, you don't have to pay any penalties. Problem is, you have to ask for it. So, maybe next time you can do that so that it's not an issue for you...good luck.

I just wanted to thank you both for you advice and input it has really helped. Your right we are are kinda young (27) and yes we do have small children. We didn't ahve a problem at the last duty station, just when we moved to backwoods GA. Again thank you.and thank goodness today is the last day in our lease.
