What is the name of your state? OHIO

Lease 2/15/03 - 2/29/04

"In the event Resident is not in default of any of the terms of the conditions of this lease, this lease shall automatically renew itself for additiponal successive periods of 1 year. Either party may terminate this lease by notice in writing to the other party 30 days prior to the end of the current lease term."
"Owner and Resident agree that Owner may unilaterally adjust the rent to be paid by resident for any Automatic Renewal Term by notification in writing addressed to Resident at the Premises of such change in rent provoded such notice was deposited in the U.S. Mail at least 45 days prior to the end of the then current term."

Rcvd notice of inc. on 1/29. On co. letterhead, slipped under door.

Recourse?

Other issues, prob. moving anyway. $1000 dep. Want to make sure they can't keep if we give notice <30 days.

Typed letter

"this will serve as addendum for <property address> for 12 months until 2/25/05"

"Please note that your monthly rent will be $$ which includes garage space @ $$ beg. 3/1/04"

"Sec. dep. is on file as $$$$. Deposit for new term is same. Reuires no additional funds. Please remit with your March payment." (Duh, couldn't delete a line from their form letter)

All other terms will remain in force. To confirm sign here. Keep copy for your records."

"If you don't return addendum lease will be mo. to mo. Add. $25 for that. 30 day notice is required prior to move out."

**A: obviously, you did not get 45 days notice.

ok, so we can legally say they can't increase, but if we don't give 3o days notice of moving out, can they come back at us? Is the entire contract invalid, i.e. can we give notice less than 30 days, or is the increase issue the only provision that cannot be enforced?
