This is from Oklahoma.

My business has been in operation since July 1999. For years 2 through 5 which began August 2000, the rent was to increase each year. I have not increased the rent payments, but each payment has been accepted. Can the landlord request back pay? Management has changed hands since July 1999.

well the most logical answer is yes.......BUT

You really should consult with a lawyer, because i know if it were a residential lease the answer would be NO, most states have a stale rent law, if the landlord doesnt ask for the rent or the increase in say 3 months then he doesnt get any of the back undercharges.

Not sure for a commercial lease.

Thank you for your response. After I received it, I did call my lawyer who informed me that the landlord cannot request back pay.
