Rent Money lost in fire

Hi,

The apartment I was renting burnt down. Two days prior to that, I told the landlady to come and pick up her money, and she said hold it and she would pick it up in two days.

Now that the house burnt down, she wants the whole months rent, do I have a right to dispute that? Should she only get the month of rent prorated for the amount of time I lived their for the month? Should I argue the fact that she was told to pick up the money before the fire, and that it was her choice to leave it for another few days, resulting in the loss of money in the fire on her property?

That's not a valid argument. It is YOUR responsibility to deliver the rent to the LL.

Depends on the cause of the fire (which was the first part of my earlier post)

Have you checked with your city to learn if they have a specific ord that addresses rent payments when a property is condemned. THEN get a copy of either the condemnation notice or fire dept report that says the unit is not fit to be lived in. At the worst you owe for a couple days of rent. If the fire was your fault the LLs insurance will be in contact with you.

I agree - otherwise, the OP would have stated (in his first post) that there was an electrical fire, or a gas line broke, etc...
