[ State -- KANSAS ] Verbal rent agreement. ??
Our son went off to college last year and another boy said he could live with him in his mobile home at $200 a month and half the phone bill. There was no written agreement. Our son just thought it was for the 10 months of school. Now the other boy called and wants $200 for June and $200 for July. The boy claims he told our son that total rent would be $2400. Our son says that $2400 was never brought up. When the other boy called last night he ended the conversation with I'll see you in court. Do we owe the $400 or should we forget about it. He will not be living with him next year.

You son had a month to month lease, and he moved out, without giving his notice, so he owes for June..

Our son was taken to small claims court. The judge reveiwed both sides and found in my sons behalf. There was no agreement for him to pay any rent past the date he paid. The judge stated that their was no rent agreement or applied agreement past the school year. Thus our son did not have to pay for the rent past the time he lived in the mobile home. The judge did state in the future both parties should have a written agreement. The judge stated most agreements in this area were for the school year and saw nothing in the verbal testamony that indicated anything else.:p
