I have been behind on my rent for 3 years. My landlord has worked with me and I pay every month. I have been on a month to month agreement since my year lease expired 5 years ago. This month I get notice that my rent is being raised 16%. Is this legal? Do I have a recourse evn though I am currently 3 months past due in rent? If I choose to question this can they legally evict me because of the past due situation? Although I know for a fact there are other tenants in the building who owe a lot more than I do and their rent increase was only 2.5%. The reason given to me in a letter is that my space is currently worth more than I am paying.And that a $150 per month increase is still $100 less than the minimum rent they get. This is also not true. If I pay this and get caught up on my past due rent can I then demand a refund if this increase is illegal? Is it legal? Can they raise it again next month? I am in LA county in California

well if you are NOT under any kind of rent regulations, then i would move asap....what is this miniumum rent you talk about? Is there some maximum rent he can charge dictated by some government agency? If Not....

Then landlord can charge anything they like, and you should be grateful you have a landlord who is rich enough to allow you to be behind 3 months on the rent,

And maybe he is raising your rent 16% becuases you are NOT giving him some nookie on the side....and the other tenants are...heh heh.

Nobody i mean nobody is allowed to be that behind in the rent....YOU do owe the money ALL OF IT.....

So use this thingy called a computer, and go to http://www.ebay.com and start selling everything that you own and pay him the rent. then you wont get evicted..

Now does that sound fair?

to Djdj: Your sarcasm is most funny... I do however get your point although you did not answer my question. Is there a cap in LA on rent raise?
