my question is .. i live in so.illinois in a trailer park, so i pay what you'd call lot rent. i moved in on the 10th of the month. i feel my rent is dued on the 10th of each month. my landlady wants the rent due the 1st. of the month.i don't pay it the 1st , i pay on the 10th and she charges me late rent fee. i feel that if she wishes me to pay on the 1st , i'm entitled to reimbursement for the 10 days. she doesn't see it that way. so am i entitled to the reimbursement ? and is it legal for her to charge me late fees? is there any legal actions i can seek? sincerly, terri00914

How does one "feel" that the rent is dued on the 10th? Is it like being in love?

I would prefer looking at your contract. If it says that the rent is due on the first, then you are in deep due-due if you don't pay it on time.

I don't know Illinois law.

Without any contract at all, the payment date is probably whatever was agreed upon. Go prove it. How much did you pay for the first month when you moved in?

When i moved in I paid 1 months rent & 1 month security.I wouldn't mind paying on the 1st of the month... I just feel she owes me 10 days rent. It doesn't have to be cash money , just divide the 10 days out of 30 days rent and apply to another month rent. I'm not trying to rip anyone off but at the same time I don't wish to be ripped off either .

Sounds reasonable to me. However, landlord can apply some move-in costs that says that what you paid when you moved in was accepted as rent for the month.

Pay rent on the first, avoid late fees and exposure to eviction, and argue separately over the 10 days.
