I am purchasing a home by rent to own. The contract was signed in April of 2003. An attorney drew up the contract. I paid $4,500.00 down on the property. At the time the contract was drew up I was showed the property lines of the prpoerty. We where told that the house was remolded 2 years ago. that it had "new floors, and new carpets".

PROBLEM # 1. Since the contract was signed I have been showed "new property lines" by the family. They mistaked the lines when they showed them to me earlier. These new property line cuts my yard to nothing! We tried to figure these out by the deed..which goes by drain pipe, metal stake, rock and tree...but have of these no longer exists. I want to put up a privacy fence and included the property that I was first told belonged to me. If I do so, if they want to protest it what can be done? Who would be liable for the survey? The neighbors tell me the lines that was showed to me first are the correct property lines of the property.

PROBLEM # 2. Since I signed the contract the floor in the living room rotted out...my entertainment centers right side feel through. and the floor under the water heater is sagging 4 inches down. I came to find out the water heater once busted and they never replaced the floor. When I asked the brother of the "OWNER" about this he swears he replaced all the floors in the house with plywood and I should not be having any problems. The water heater has been checked and it is not leaking...But when the living room floor was ripped up the problem we found is they laid a new floor of PARTICLE BOARD OVER A FLOOR OF ROTTEN PARTICLE BOARD! I am now having to replace the floors in the kitchen, laundry room, bathroom and the floor under the water heater because they are all particle board and are rotten. In the contract it does say that I would be responsible for any and all repairs made to the property. The question here is..I was lied to I was told that there was new floors down..What can be done here?

PROBLEM # 3 Since the contract was signed the father of the "OWNER" sits on his porch (which is across from my house) all day long and watches my house. At any time of day or night that I go outside he is there...I am a single mother of a little girl and this bothers me it makes me feel very uncomfortable in my own house. I have hung quilts over my blinds and curtains because of this..(This is why a privacy fence is needed) Are they anything I can do about this?

PROBLEM # 4 My 18 year old brother comes and stays with me sometimes and The BROTHER OF THE "OWNER" will come and make passes at him while he is outside. He has offered my brother money and drugs to "preform acts of sex" with him!
This is become quite a problem since he has done this to another brother of mine recently. The BROTHER OF THE "OWNER" was Tried but not convicted (that I know of) for molesting and commiting sodomy on a mentally retarded boy of the age of 18. He lives 2 houses from mine. Should this have been disclosed to me before I bought the house? This really concerns me with the brother and the father of the owner, whereas I feel myself, my child, and my brother might be endangered to these men. What are my rights?

PROBLEM #5 The family of the "OWNER" still think they own this property. They come and park their broke down vechiles in my driveways, when they come and work on them strange people are coming and going all day..oil has leaked out in my driveway. They throw their trash and brush in the creek (on my property) which causes it to flood my back yard when it rains. They tell me I cannot cut or trim the trees in my yard..(Which 2 are dead). What are my rights here.

Problem #5 In the contract it states that the man I bought this house from is responsible for the property taxes through 2003. There where back taxes due. He promised that these would be paid with the money I gave him for the down payment of the home. The taxes have not been paid as of yet. What are my rights here?

Any help at all would be appreciated..Please let me know what my rights are and if I can possibly take legal action for anything noted above. Are they any way this contract can be cancelled and voided out? Are they any way if so can I get any of my money back for the repairs and downpayments and payments that I have down associted with the house. Please advise me I am in need of advice as soon as possible.
