I am selling a houe on a rent to own basis. The lady who is purchasing the home is not living up to the agreement. She has only had 2 payments one of which I have not received yet and the first was very late. She did not cover the home with insurance as agreed apon in the agreement and she has not paid the property taxes within the time limit given in the agreement. In the agreement it states that if she fails to do any of the items listed that I have the right to declare the agreement null and void, can I now do this and if so do I have to return her down payment? Thank you.
