Does a person have to check 'yes' on a rental agreement to the following question:

Have you ever been convicted of, or pled guilty or no contest to, any criminal offense(s) or had any criminal offenses disposed of other than by aquittal or a finding of not guilty.

If the following is true: person was arrested in 1996 and decided to take the ARD program which the person had to hand in their license for 90 days and go to safe driving courses. After one year the persons record was completely expunged - therefore deleted from their record.

Read the application question again. A DUI is criminal offense correct?
