I live in New Mexico and was in a car accident that was not my fault . The car is totalled . The insurance company uses Nada to come up with a value for my car and it is about $500 less than the Kelly Blue Book value . Of course I want the higher value . Who is right? Also I rented a rent a car and the insurance company only paid for a part of it . They said that they are not intitled to pay for the rent a car but that they paid for it as a courtesy . They said that in NM that if the car is totalled they don't have to pay for the rental, only if my car is being repaired do they have to pay for it . They paid about 10 % of the bill . Any help would be welcomed .

Your situation sounds normal. Now you know why insurance companies use the NADA book instead of the Kelly blue book. Everything done was legal and within their rights.
