I signed an apartment lease along with a security deposit.
I want to move out before the expiration due to a frequent,
repetitive noise from a neighbor. I believe it is a medical device such as a pump or generator and it is disturbing to my sleep. I complained (in writing) to management, but the answer was basically "move out when your lease expires".

If I leave, I can I be assured they do not keep the deposit? If they do, what is my recourse? I would prefer to avoid small claims court.
