We rented a duplex Bottom floor. First last and security in an upscale neighborhood. The two girls who lived upstairs worked for the landlord.
The had a disagreement and the next thing I know a man from the housing authority came to the door and said the house was illegal. The neighborhood was only zoned for single family.
The Landlord had covered the staircase that was inside with a closet so you never knew there was a staircase there to the second floor. The upstairs was a full two bedroom apartment. He made one house into two knowingly.
She rented us that home under false pretense.
She had another home next door that was empty and said we could have that one but it was more money than we were comfortable with but we had no choice because we spent all our money getting into the duplex and since it was affordable we bought a new car knowing we could handle it.
Now we are behind and did not sign a lease for this house.
Are we entitled to the full amount of rent we paid at the duplex since the lease was signed under false pretense? Also, are we entitled to pay late fees on a house that we have no lease on?What is the name of your state (only U.S. law)?
