I live in New York State and rent a mobile home on private property. My rent is $400 per month and the landlord wants me to pay $5.00 per day per person for late fees for every day the rent is late after the 7th of the month.
My parents use to rent from a trailer park and their lease had a clause that reads "Any payment over 10 days delinquent will be considered late and a late fee of $15.00, being less that (five) 5% of the payments allowed by law, shall be charged for each late payment.
In the state of New York is there a law that limits the amount of late fees a landlord may charge?

DO YOU HAVE A LEASE? should always be the first question.

With no lease the landlord can change the terms of a month to month lease with at least 30 days notice....

There is no law which prohibits the landlord from charging excessive fees, but he will have them taken away and reduced to a more reasonable 5% by a judge if the landlord sues you for non payment of rent.

Thank you for your promt response. Yes, I do have a lease and in the lease it says $5 per day per person. There are 3 of us living there - 2 adults and a 2 year old. I still feel this is excessive. Again thank you for your help.
