recently I wrote to you regarding the responsibility of the landlord to repair a broken hot tub and fence in the back yard.
I sent a certified letter with the rent check, a request for repair form and the 3rd letter asking and explaining the repairs needed. I have not heard from the LL yet.
You advised me to check with the City for ordinances and health laws that may be in place for some of the repairs I need.
So far I have left voice messages but have not yet talked to a person.
The statement below defines what condition would require the LL to make repairs regardless what is in a lease contract.
"The warranty of habitability requires the landlord to make reasonable efforts to repair any condition which materially affects the health or safety of an ordinary tenant. "
Here is my question.
In your expert opinion would the following conditions fall under a condition that materially affects my health & safety ?
1. Broken hot tub on patio with standing, filthy water.
2. Tiles that are popping up in the house that cause me to trip ( no carpet in house)
3. no working smoke detector
4. standing water in bottom of refrigerator (under vegetable/fruit drawers)
5. blackish mold covers air condition unit in house
6. Also, their are three,5 gallon buckets in wall behind air condition filter that catch drips from leaky air conditioner pipes.

health dept offers no help

Just got off the phone with the Health dept. (environmental department).
They tell me since I live in the house is my responsibility to clean it up, not the property owner. I am shocked but whatever. I will continue to try contacting the city to see where I stand with city codes/ordinances.
:(
