rental with contract

My friends have been renting a condo without any rental contract for the past three years from the lack of business professionalism of the owners of the condo. They have run into some financial problems and could not make rent for past two months, therefore, they have moved out of the dwelling. The owners have threatened them with lawsuits but since there was no official rental agreements are they considered squatters for the past three years? Can the owners take them to court knowing they cannot show the judge any official legal documents concerning rent?

They paid rent for 3 years (less 2 months) - that's pretty indicative of a LL/Tenant relationship :rolleyes:

and you friend's not paying rent, and sneaking out of the condo would be????????

He owes rent for the 2 months he didn't pay, and probably at least one month after he moved out since he did not give any notice he was moving. Plus he will owe for any damages to the apartment.

The tenants are responsible for rent during all the months of occupancy and for the thirty (30) days of the next rent cycle following move-out. The proof of residency and month-to-month lease can be proven by the past three years of rent payments. The tenants had a month-to-month rental agreement and (although not in writing) is still enforceable as a standard lease agreement with a month-to-month term.
