After purchasing a home, I had a very close friend move in to help in out after his divorce. I did not have a rental agreement signed with him, but we agreed that reant would be $550 per month including utilities, but he would have to split the phone bill each month. Nine months had passed, and due to some things, I could not live with him anymore and asked him to move out, but I would give him sufficient time to find a new place to live. The next week on a Wednesday, he told me he was moving the next day and that was it.
After arriving home after work on Thursday, all his stuff was moved out, but there were a few things wrong. Upon himself when he moved in, he chose to put up shelving in his closet and a ceiling fan, and when he moved out he took the ceiling fan doen, which was fine he bought it, but he ripped out the shelving that he replaced with the original, leaving $250 worth of damage. Now to my knowledge, if it is a fixture, it should be left in the home whether you are "renting" per say or not. Also, the $550 was paid each month, but the split of the phone bill was never paid. I am not sure if I were to take this to court if it would uphold without a written rental agreement. any advice???
