We rented a house in Colorado for our vacation. While there the shower curtain and rod (installed by the home's owner) fell due to no tension in the rod. We noticed a small nick in the tub surface that had been hidden by the shower curtain but could find no evidence of it being fresh damage (i.e. no chipped porcelain or paint). The owner of the house claims that the damage wasn't present before our occupancy and is holding our deposit money until it is convienent for her to have the damage repaired. We have tried to explain that we didn't cause the damage but the property manager has stopped responding to our emails and won't answer our calls. The owner of the property was supposed to call me three days ago but hasn't yet.

Should we, as renters, be liable for damage caused by a faulty shower curtain installed by the owner?

How long has it been? The problem is, they're counting on you not being willing to return to CO to take them to small claims court. Are you?
