Renters Using Deposit for Last Months Rent

Our tenants are moving out on October 1st. Received a message on September 9th that they have no intention of paying September rent and that we should use the security deposit to cover this. I phoned them and told them that the Deposit could not be used for the rent and that I needed some sort of insurance that I would have the property returned to me in the same condition that they received it in (brand new)
My questions is how do I get them to pay for any damages/messes, if any, to the property.

I had a similar situation. I posted a 5 day notice then filed for an eviction. The tenants didn't show up for court so I got a judgement for everything I was asking for. (rent, deposit since they didn't give a 30 day notice, plus damages) Ofcourse they will prob. be moved out by the time you get a court date but atleast you will get a judgement against them. I would prob check w/an attorney in your area or local l/t laws. good luck
